TERMS AND CONDITIONS

 

1. Seller

Bohélie Fabrics (Heikant 18A in Houwaart, Belgium) is owned by Roeland Van Coppenolle bvba, run by Aurélie Iwens and has it's registered office in Belgium, at 3390 Houwaart, Heikant 18A and is registered with the Crossroads Bank for Enterprises (CBE) under number BE 0893.808.379.

 

2. Application

Each order constitutes acceptance by the buyer of our general terms and conditions, which are an integral part of the agreement, to the exclusion of all other general or special conditions issued by the buyer, unless expressly stipulated otherwise in writing.

 

3. Prices

All our prices are expressed in euros. The prices include VAT but exclude shipping costs, with the exception of certain promotions clearly stated on the site. The shipping costs are added to the payment of the order and depend on the amount of the order and the country to which the order is shipped. Within Belgium you pay € 5.7 for orders below € 100. From 100 € your order will be shipped free of charge. Free shipping expires during promotions. Offers are valid as long as they are included on the website. Prices can always change. When placing an order, the price that applies at the time of the order always applies. Bohélie Fabrics cannot be held to clearly incorrect prices in the webshop, for example as a result of clear input, printing or typing errors.

 

4. Pre-order reservations

When pre-ordering, the products are reserved and paid for in advance. Delivery only takes place from the moment the products are available.

 

5. Order

After placing your order, you will receive an automatically generated e-mail with the confirmation of your order. If an item is no longer in stock, you will be notified within three working days. Orders can only be placed through the webshop. No orders (nor changes or additions to orders placed online) will be accepted by phone, email, facebook or other media.

 

6. Payment

Payments must always be made in one transaction. When paying for the order you can choose between different payment options. Goods are not prepared until the payment is registered with Bohélie Fabrics. If the order is not paid immediately, there is always a risk that the goods are no longer in stock when the payment is received. You will be informed of this by e-mail.

 

7. Delivery

After receipt of the payment, the package will be sent within two working days. ATTENTION: when paying by bank transfer, it can take a few days before the amount is in our account. All envelopes and parcels are shipped with Bpost, DHL or DPD. Within Belgium, the delivery time is estimated at three working days, but this is not binding. Bohélie Fabrics is not responsible for late deliveries as a result of strikes, unexpected closing days or busy periods (eg Christmas) at the carriers. No delay in delivery may lead to cancellation of the purchase or the payment of compensation in favor of the buyer, except in the case of deliberate delay caused by the seller. An incorrect delivery address is the responsibility of the buyer and can lead to additional costs at the expense of the buyer.

 

8. Right of renunciation - return

You have the right to cancel the sales agreement and / or to return the delivered items without payment of a fine or statement of motive and this within 14 calendar days after delivery of the products. If you wish to exercise this right, you must return the goods in their original condition and packaging, at your own risk and expense, to Bohélie Fabrics, Heikant 18A, 3390 Houwaart, Belgium. The purchase amount will be refunded as soon as we have the items in our possession.Returning meter goods is only possible from a minimum length of 100 cm or a multiple of it. Goods specifically designed for the buyer will not be taken back.

 

9. Complaints

Complaints related to incorrect delivery are taken into account if they are reported within eight days of delivery.Complaints regarding hidden defects must be reported within eight days after discovery of the defect or after the moment when such discovery could reasonably have occurred. Every complaint must be reported in writing (info@bohelie.be). The receipt of the goods by the buyer covers any possible defect or non-conformity which could then be established.

 

10. Guarantee

Our guarantee is limited to the guarantee for hidden defects and the guarantee in the event of a consumer purchase, both provided for in the Civil Code. We only guarantee damage that is the result of intent or gross error. We are not liable for general or special indirect damage, or whatever nature, suffered by the buyer.

 

11. Risk of shipment

We are not liable for loss, theft or damage during shipment via the carriers. All products are packed with the greatest care so that the risk of damage is as little as possible.

 

12. Personal data

By placing an order, you agree to the use of your personal data for order management, deliveries and invoices, marketing and advertising. Processing for marketing purposes only takes place if you expressly agree to this. The data is not passed on to third parties. You always have the right to inspect and correct. You have the right to object to processing for direct marketing purposes at any time. For more information, you can apply to the public register kept by the Commission for the Protection of Privacy in Brussels.

 

13. Governing law

All agreements concluded with the seller are governed by Belgian law. The court of Leuven has exclusive jurisdiction.

 

14. The use of images from the webshop

Sharing photos from the webshop is only allowed, when Bohélie Fabrics is tagged with a clear link to our website www.bohelie.be or our social media pages. Bohélie Fabrics, Aurélie Iwens, reserves the right to change the conditions at any time and without notice.
